A Grade 1 Area Court, Dei-Dei, Abuja on Tuesday struck out a case of theft filed against a 25-year-old bartender, Azim Maxwell, for lack of diligent prosecution.
Maxwell, who lives in Karmo, Abuja pleaded not guilty to the charge.
The Judge, Sulyman Ola struck out the matter saying the Prosecution Counsel, Chinedu Ogada had not been diligent in prosecuting the case.
”The counsel had shown lack of interest in this case and was absent from court without reasons’.. he held.
Earlier, Ogada told the court that the complainant, Mr Ijale James of Blooms Hotel, Saburi residential district, Abuja reported the matter at the Gwagwa Police Station on July 6.
Ogada said that the complainant employed the defendant as a bartender in the hotel and put him in charge of the bar.
The prosecution counsel alleged that the defendant sold drinks worth N350, 000 and converted same to his personal use without the complainant‘s consent.
The offence, he said, contravened the provisions of Section 289 of the Penal Code.
